General information

The general conditions of sale contained in this page apply to all products and services sold exclusively through fastandlight.ch e-commerce website. They define the rights and obligations of the parties.

Fast and Light reserves the right to modify at any given moment the content and terms of these general conditions of sale.

fastandlight.ch, the seller, also known as Fast and Light, is a commercial trading name owned and operated by Tim Barnett and used under license by FAST AND LIGHT SARL, a Swiss corporation based in Vaud.

Sales contract
By confirming their order the customer accepts our terms and conditions and is bound through this sales contract that is generated through this action between Fast and Light S.A.R.L. and the customer.

Newsletter subscription
At the checkout stage of any purchase, and on other pages of the Fast and Light website, the customer is given the option to subscribe to our newsletter. This subscription can also be offered by our customer service, social media accounts or on partner websites. By subscribing to our newsletter, the customer accepts the present terms and conditions. The customer can unsubscribe from this newsletter at anytime.

Personal data

Data protection and data accuracy
The customer has to provide FASTANDLIGHT.CH with the personal information necessary for the management of their order (delivery and billing). This information must be accurate, valid and up-to-date. The use of wrong data or the abuse of identity is fraud and will be prosecuted according to Swiss penal laws.

All customer details will stay confidential, and FASTANDLIGHT.CH commits to respect the agreement dictated by the Swiss Distant Selling Association and will respect the terms of Swiss data protection Swiss legislation.

Customer data will only be used to handle and process the customer’s order, for communication with the customer, for business planning and evaluation, for marketing purposes by FASTANDLIGHT.CH and for personalized offers adapted to each customer.
FASTANDLIGHT.CH shall respect the privacy of the personal data communicated by the customers on the FASTANDLIGHT.CH website and shall manage the data in accordance with applicable legal obligations.

Customers’ data may be used by Fast and Light internal services for the following purposes:

Management of orders, deliveries and billing
Inform the customers of sales, special offers, vouchers and coupons and events by way of e-mails and newsletters
To improve and customize the communication and offers for the customer

Login details
The information concerning the customer’s identification, login and password shall be kept secret by the customer.

Change of customer details
FASTANDLIGHT.CH appreciates customers informing us of any change in their name or address details BEFORE placing an order to ensure smooth delivery of their items.

Newsletter
By subscribing to the Newsletter, the customer accepts that FASTANDLIGHT.CH communicates regularly with them with offers and news and accepts that we use his data this way. At any time, the customer can contact FASTANDLIGHT.CH or use the appropriate box or links on the website or in the newsletter to unsubscribed from such newsletters.

We use a trusted third party payment processing service to process your payment (Paypal) and we do not store your credit/debit card information.

With respect to your personal information that we do store, such as your name, address, email address, telephone number, age, occupation, and style preferences, we follow strict security procedures in the storage and disclosure of personal information to prevent unauthorized access or unlawful processing of your personal information. IP ADDRESSES AND COOKIES
An Internet Protocol (IP) address is a set of numbers, which is assigned to your computer during a browsing session. It is automatically logged by our servers and used to collect traffic data about visitors to the FASTANDLIGHT.CH website. We do not use your IP address to identify you personally.

FASTANDLIGHT.CH uses cookies to distinguish customers from other users of our website and to keep track of their visits. This helps us to provide customers with the very best experience when they browse our website and helps us to make improvements.

Site Statistics and use of ANALYTICS tools
In order to better serve our website visitors and customers we use Google Analytics features and services which may  include Remarketing, Google Display Network Impression Reporting, DoubleClick Campaign Manager integration or Google Analytics Demographics and Interest Reporting.

Customers can opt-out of the Google Display Advertising Features and customize Google Display Network ads using the Ad Settings.

As an added privacy measure, customers can use the Google Analytics opt-out browser add on.

FASTANDLIGHT.CH will not facilitate merging of personally-identifiable information held or collected with non-personally identifiable information collected from Google Display Advertising services without prior consent of the customer to such merger.

Product and Pricing Information

On occasion, information on this Site may contain errors, including, without limitation, typographical errors, translation errors,inaccuracies, or omissions related to product availability, pricing information, product descriptions, special offers, product promotions, or product shipping charges and delivery times. Fast and Light reserves the right to, at any time and without prior notice, correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on this Site is inaccurate (including after you have submitted your order).

Products offered through this Web Site are offered subject to availability. While we do our best to ensure that product and pricing information is current and complete, we are not liable for inaccurate information or for any information that has been omitted or is out of date.

Prices for products and services are quoted in Swiss Francs and €uros.

We may, from time to time, offer promotions for shipping and other discounts on purchases. We reserve the right to suspend any such promotions, update product information, change prices and adjust shipping and handling fees at any time without notice. Furthermore, we reserve the right to change, limit, refuse, or cancel any order you place with us in our sole discretion. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

Orders
Once the desired product has been chosen, it is placed in the “shopping cart” by clicking the button “Buy”. The customer may then continue their selection of products, modify their shopping cart or proceed to “check-out”with the payment of the order.

The confirmation of the order by the customer serves as acceptation of the general conditions of sale.

Once the order is confirmed and paid for, the customer receives confirmation by e-mail of their order.

Prices
All prices on the  FASTANDLIGHT.CH website are in Swiss Francs and Euros and are inclusive of all taxes (including 7.7% VAT), but excluding expenses of packaging or delivery. Delivery expenses of the order will be indicated prior to the final confirmation and payment of the order.

FASTANDLIGHT.CH reserves the right to modify, without prior warning and at any moment, the prices and other fees published on the  website.

In case of an error with pricing on our site,  FASTANDLIGHT.CH reserves the right not to deliver the products, but will inform clients who have ordered on the difference and potential alternative products.

Sale prices
FASTANDLIGHT.CH will from time-to-time have sales and promotions on its website. Those special offers are only valid at the time of the publication and cannot be claimed afterwards.
As is usual in fashion retail, FASTANDLIGHT.CH proposes reduced prices and discounts at certain times in the year on selected products. It can vary, but usually products are on sale at a lower price towards the end of the season to clear stock for the next season. It is therefore normal that when buying a product at a certain moment, a customer cannot in principle claim any compensation for subsequent changes in prices of that product.

Coupons and vouchers
Coupons, vouchers or rebates distributed through the website, newsletters, social media channels or through partners are exclusively valid within the terms mentioned in the offer.
Coupons and vouchers are in form of codes and must be entered in the specific field during the check-out process. In no case can those codes or rebate offers be used afterwards.

Quality
FASTANDLIGHT.CH pays a great deal of attention to the manufacturing and on the selection of the products that we sell on our website in order to guarantee their quality. Should a customer has any quality issue with our products, please contact us.

Depiction of the products
We endeavor to ensure that the products and services sold through the website are depicted by photographs and descriptions with the highest possible accuracy. However, due to technical issues beyond our control such as the customer’s screen and monitor settings, it is possible that the perception by the customer of the photographic depiction of the products does not exactly correspond to the products themselves.

Payment methods
Payment of the orders on the  FASTANDLIGHT.CH website are performed through Paypal which provides secure requirements for international transactions.

At  FASTANDLIGHT.CH, we make payment easy. Immediately online payments are taken through Paypal using Visa, Mastercard or American Express or Paypal account balance.

For customers requesting a delivery in Switzerland, payment by PostFinance is also possible by contacting FASTANDLIGHT.CH directly.

We also accept prepayment by bank wire transfer to complete orders.This payment method needs to be made within 3 business days with the exact information provided in the confirmation email. We can only guarantee availability of your order within this time frame.

For Swiss customers we can also offer COD – cash on delivery? Customers easily pay the mailman or at the post office when picking up their parcel. This service is charged at CHF 15.00 by the Post and is non-refundable in case of return.

Orders will be considered effective upon receipt of the approval by the bank payment center.

In accordance with applicable legislation and to ensure the security and privacy of the customers’ information, FASTANDLIGHT.CH does not take or store or save the credit card or banking data of customers. It is therefore up to the customer to save and print their proof of payment if they wish to preserve the details of the transaction related to their order.

FASTANDLIGHT.CH uses SSL encryption for all forms so that address details entered and passed on to the banks are secure.

Delivery and shipping
We ship your orders in the shortest possible time, generally at the latest at the end of the first business day after the order has been placed on the website.

Shipping is free to addresses in Switzerland for orders providing the minimum cart amount is met except where specifically mentioned on the product details page and in the check out.

FASTANDLIGHT.CH reserves the right to split an order in to several packages, or to regroup orders made by the same customer in order to deliver to the same address.

Stock for products or raw material can prevent us from delivering a product. In those cases we will inform the customer in the shortest time, and to propose alternative products. In any case, a refund will always be possible.

To destinations outside of Switzerland delivery fees are payable by the customer and calculated at the end of the order process during check out on the basis of the delivery country, weight, volume and the tariffs of the carrier. These fees are paid by the customer unless free shipping is offered as an option on check out.

FASTANDLIGHT.CH guarantees the expedition of the products and services sold through the FASTANDLIGHT.CH website to Switzerland, France (Metropolitan), Italy, Belgium, The Netherlands, Germany and the United Kingdom. Other countries are by special arrangement before completion of the order process.

The products and/or services will be sent to the delivery address indicated by the customer during the order process.

Starting from the order and the confirmation of payment, the times of delivery, given here on an indicative basis only, are as follows:

8 working days for Switzerland, France, Germany, Italy, Belgium, The Netherlands and the United Kingdom

15 working days for other destinations.

All our parcels are properly insured up to your door.

Upon completion of the delivery, the bill-of-sale/invoice will be available on the FASTANDLIGHT.CH website.

Returns, withdrawal and refund

No purchase obligation – right of withdrawal
FASTANDLIGHT.CH makes a commitment to take back any goods 14 days after the reception of customers parcel and to reimburse the customer as soon as possible. Reimbursement will be made after deduction of potential promotions, coupons, reductions or sale offers that were given at the time of purchase.

No reimbursement can be made when items are returned used or damaged or generally in a condition where they cannot be re-sold to another customer in a brand new condition.

Items must be returned complete, in their original and undamaged packaging, with all labels attached. Shoes must be returned in their original boxes. Stamps, stickers or labels provided in the original package must be used for returns in order for FASTANDLIGHT.CH.

FASTANDLIGHT.CH does not offer free returns for deliveries inside or outside of Switzerland. FASTANDLIGHT.CH reserves the right to change our returns policy at anytime.

Made-to-measure and Customized products such as ski equipment mounting cannot be returned or refunded, other than for manufacturing or material defects.

The procedure for returns is as follows:

The product must be complete, correctly protected, in its original package with any protective film or protective wrapping intact, along with all its accessories, documentation and labeling.

The product must be sent along with:

• The order number or reference of the return request provided by FASTANDLIGHT.CH
• A copy of the sales invoice

The product is then checked and controlled by FASTANDLIGHT.CH customer services, which will decide whether to validate the refund, in particular by verifying that the product has been integrally returned and in a state fit to be re-sold, as provided by the right of withdrawal.

If the goods satisfy the above conditions, they might be entitled to a refund.

Refund of return postage fees. Generally we do not offer free return purchase or refund postage charges unless the error is made by us. An example of an error would be us sending the wrong product or size initially.

If the goods do not satisfy the above conditions, they will be sent back to the customer at their expense, who will not be entitled to a refund.

Warranty

FASTANDLIGHT.CH garments, leather goods, footwear, bags, accessories, sportswear are covered by a one-year guarantee against all material and manufacturing defects.

The guarantee does not cover damages related to normal wear and tear, accidental damage, bad maintenance, damage arising from improper use, shocks, or loss.

Items benefiting from a guarantee are subject to the terms and conditions at the time of purchase. Guarantees take effect at the delivery date of the items and must be justified by the documents enclosed (invoice) that we ask the customer to keep for this purpose.

Repairs
The customer may contact FASTANDLIGHT.CH Customer Service for any request for information or an estimate for repair, but only for the products bought through the FASTANDLIGHT.CH website.

Only by invitation of Fast and Light Customer Services, the customer may be requested to send back, at their own expenses, the item to be repaired and with the following:

• A copy of the sales invoice
• With a written description of the problem encountered
• The exact address of the customer for the return of the product

After examination by Fast and Light Customer Services:

• If the repair is not covered by the guarantee Fast and Light Customer Services will provide the customer with an estimate
• If the repair is covered by the guarantee, the product shall be automatically repaired and sent back to the client free of charge

The time necessary to make the repair will be given by Fast and Light Customer Services on a case-by-case basis.

Applicable law

The present general conditions of sale, as well as any sale to which they apply, is subject to Swiss law. Any litigation or dispute arising from or in connection with these general conditions of sale or with any sale to which they apply, whether the claim is based in contract or in tort or upon any other legal foundation, will be settled in accordance with Swiss law.

Application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
