Ski and Snowboard Waiver – Release Of Liability

By adding the ski mounting, servicing or repairs to your order, you agree to the release of liability form stated below.

Returns or Exchanges:

When we are mounting your skis, we are drilling holes in them, you may not return or exchange your product. All new Skis and Snowboards come with a 1-year manufacturer limited warranty.

There are no warranties on used equipment.

Occasionally, as we are human, mistakes in mounting, repairs or servicing can be made. Our Liability is limited by the terms of this agreement, however if such an error occurs, we will do everything to try to rectify the issue.

Release of Liability:

I acknowledge that I am at least 18 years old and that I must read and accept the terms of this Waiver as indicated below as a requirement for requesting that Fast and Light / Edi-Line SARL. mount the bindings and skis or snowboard that have been selected and purchased in my shopping cart or paid for in store.

I have carefully read, the terms of this Waiver and understand and agree to the terms of this Waiver.

I understand and agree that this is a legally binding contract.

I authorize Fast and Light to perform such work that is necessary to properly mount, test and/or repair my skis, bindings and/or boots (called “Equipment” in this document).

WARNING

WARNING: BINDING DIN SETTINGS MUST BE ADJUSTED BY A CERTIFIED SKI TECHNICIAN BEFORE USE. FAST AND LIGHT DOES NOT SET YOUR BINDING’S DIN SETTINGS.

ASSUMPTION OF RISK WITH SNOW SPORTS

I understand and agree that participation in skiing, snowboarding and related activities is HAZARDOUS and is not without significant risk. I understand that the same elements that contribute to the unique character of such activities can cause loss or damage to the Equipment as well as injuries that can in some cases be permanent or even death. I understand that such injuries and even death are common and ordinary occurrences during these activities.

I elect to participate in such activities using the Equipment despite the inherent and unknown risks and the possibility of injuries and death described above. I accept and assume full responsibility for ALL RISKS associated with such activities, including injury and death associated with the use of the Equipment. My participation in such activities using any items of the Equipment is purely voluntary and I have not been coerced or forced into participating or using the Equipment.

Ski and Snowboard Bindings

I understand that the ski-boot-binding system is designed to release the boot from the ski when certain forces on the system reach pre-set values, but that the binding MAY NOT NECESSARILY always RELEASE OR RETAIN THE SKI where release or retention may prevent injury, and that RELEASE OR RETENTION CANNOT NECESSARILY PREVENT ALL INJURIES OR DEATH.

I understand and agree that:

(a) lower settings on the bindings will increase the ease of release but also increase the risk of injury that may be caused by inadvertent release of the ski.

(b) higher settings on the bindings will increase retention but also increase the risk of injury that may be caused by retention; and

(c) injuries due to unwanted release or retention of the ski are inherent risks of skiing.

Ski and Snowboard Activity Risk

I understand and agree that certain risk of skiing and snowboarding may be reduced, but not eliminated, by:

(a) taking lessons or being supervised by a qualified professional,

(b) following the code of responsibility of most winter sport recreational and ski resort areas, and

(c) using reasonable care and common sense. I further understand that a leash, ski stopper or other runaway prevention system is always required with all skis and snowboards, including while riding lifts and while carrying snowboards on or near a slope, to reduce the risk of injury to others.

LIABILITY RELEASE

Risk to others whilst using Equipment.

I understand and agree that I will be responsible for all injuries to others caused using any item of the Equipment by me or any other person. I will be responsible for all damage to the property of others or injuries or death to others resulting from the use of any item of the Equipment by me or any other person.

To the fullest extent allowed by law, I, on behalf of myself, my spouse and other family members, my heirs, executors, representatives and estate, hereby agree to forever WAIVE, RELEASE, DISCHARGE AND PROMISE NOT TO SUE OR ASSERT CLAMS AGAINST EDI-LINE SARL / FAST AND LIGHT, and all manufacturers and distributors of any item of the Equipment, as well as their respective owners, agents, employees, affiliated companies and successors and assigns, from ANY AND ALL RESPONSIBILITY, LOSSES, CLAIMS, SUITS, CAUSES OF ACTION, DAMAGES, EXPENSES OR ANY OTHER LEGAL LIABILITY incurred by them or arising out of the use of any item of the Equipment by me or any other person, including without limitation, any damage to property of, injuries to, or death of any user of any item of the Equipment, whether resulting from such parties’ negligence or any other cause.

INDEMNITY AND HOLD HARMLESS AGREEMENT

I hereby further agree that I WILL HOLD HARMLESS, DEFEND, AND INDEMNIFY SUCH PARTIES if any claims, suits, causes of action or other legal action is pursued by any third parties against them for any injuries, damages or death related to the use of any item of the Equipment by me or any other person.

I accept the Equipment “AS IS” and with NO WARRANTIES, express or implied, beyond the applicable manufacturer’s written limited warranty, if any.

For and in consideration of submitting my Equipment for mounting, servicing and repair, I AGREE TO RELEASE Edi-Line SARL. / Fast and Light of any negligence arising from the maintenance, transportation, mounting, tuning, selection or adjustment of this Equipment.

I understand how to use this ski/snowboard-boot-binding Equipment and how it works. I have been fully instructed in its proper use or I will get proper instruction before using this equipment. If on the Equipment, I will verify the binding release/retention settings on the binding visual indicator correspond to my weight and activity ability before using this equipment. I agree to have the user check this equipment before each use and I will not use this equipment if any parts are worn, damaged, or missing. I will have read the manufacturer written instructions when provided.

This document is a LEGALLY BINDING CONTRACT which supersedes any other agreements by or between the parties, and which constitutes the FINAL AND ENTIRE AGREEMENT regarding this transaction and this equipment. This document is intended to provide a COMPREHENSIVE RELEASE OF ALL LIABILITY which is binding upon and for the benefit of all parties, their heirs, agents and assigns, but it is not intended to assert any claims or defense that are prohibited by law. If any part of this agreement is held to be invalid or unenforceable the remainder shall be given full force and effect. The specific legal rights of the parties may vary among different states and provinces.

I agree that this document shall be governed by and construed in accordance with the laws of Switzerland. I agree that any action or proceeding commenced under or with respect to this Agreement shall be brought only cantonal courts of Geneva and I irrevocably consent to the jurisdiction of such courts and waive any right to alter or change venue, including by removal. I WAIVE ALL MY RIGHTS TO TRIAL BY JURY OF ANY SUIT, CLAIM, CAUSE OF ACTION OR OTHER ACTION ARISING OUT OF OR RELATED TO THE USE OF ANY ITEM OF THE EQUIPMENT BY ME OR ANY OTHER PERSON.
